The Guardian report says refusal. On the BBC story, which I had not previously seen, Glen Smyth of the MPF states that he did not refuse, but requested and I do think that makes a significant difference, though I would still find it highly problematic. Equally important to me is the fact that in your example you were not a public servant, but an employee of a private contractor, albeit one which took state contracts.
